This Terms of Service govern the relationship between you and The Design Atlas (operating under the name “The Gifting Bureau”).

By accessing or using the Site, you agree to be legally bound by the Terms of Services updated by The Gifting Bureau from time to time, with or without notice. In addition, by ordering any of our products/services, or partaking in any promotions, or using the Site for any purpose, you are also legally bound by these Terms of Services.

These Terms of Services may be revised or updated from time to time. The revised or updated Terms of Services will be posted on the Site and your continued use of the Site shall be deemed and construed as your conclusive and binding acceptance of the revision or updated terms.

The Gifting Bureau reserves the right to withdraw and/or amend any policy or information regarding the use of Services without prior notice. This includes the access to certain parts and/or the entire Site. The Gifting Bureau is also not liable if, in any event, the Site is unavailable at any time, or for any period.

Use of and browsing in the Site are at your own risk. Neither The Gifting Bureau nor any party representing or otherwise affiliated with The Gifting Bureau in creating or presenting the Site are liable for any direct, indirect, special, punitive, incidental, exemplary or consequential damages arising out of your use of the Site. To the extent permitted by law and without limiting any of the foregoing, everything on the Site is provided to you on as “as is” basis, without warranty, either express or implied, of any kind, including, but not limited to, the implied warranties of merchantability, fitness for a specific purpose, freedom from computer virus, or non-infringement.

This Site may also provide you with opportunities to external links (the “Linked Sites”), or otherwise use sites and services offered through or by third-party vendors. The Linked Sites are not operated, governed or monitored by The Gifting Bureau and your use of these Linked Sites is subject to the respective terms posted by these third-party vendors. The Gifting Bureau holds no control over these Linked Sites and will not be liable for them, the content and services offered, or for any loss or damage that may arise from your use of them.

You may link to The Gifting Bureau’s Site, provided you do so in a way that is fair and legal and does not damage and/or disparage or take advantage of our reputation. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where non exists. You must not establish a link from any site that is not owned by you. Linking to our Site does not constitute to any form or endorsement or authorisation from The Gifting Bureau. The Gifting Bureau reserves the right to withdraw linking permission without notice.

Failure or delay by The Gifting Bureau, at any time during the term of the agreement, in exercising any rights or remedies stated in this Terms of Services, does not constitute a waiver of such rights or remedies, or affect any other subsequent event of impair any rights or remedies in respect of it. It does not relieve you from compliance with such obligations. A waiver by use of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of these Terms of Services shall be effective unless it is expressly stated to be a waiver, communicated to you in writing and authorised by The Gifting Bureau.

These Terms of Service shall apply at all times and shall prevail over any separate terms put forward by you. Any conditions that you submit, propose, initiate or stipulate in whatever form and at whatever time, whether in writing, by email, or verbally, are expressly waived and excluded. No other terms shall be binding unless agreed in writing, authorised and signed by The Gifting Bureau.

You agree to indemnify, defend and hold The Gifting Bureau from and against all claims, losses, damages, costs and/or expenses, including legal fees on an indemnity basis, arising from your use of the Site or any breach of the Terms of Services.
